Terms and Conditions of Sale – Il Cashewficio

(pursuant to Legislative Decree 206/2005 “Consumer Code”, Legislative Decree 70/2003 on e-commerce and Article 59 of Legislative Decree 21/2014)

1) Who we are and where we operate

Il Cashewficio – La Fromagerie Vegetale S.r.l. (Tax Code/VAT No. 02601960996) is the seller of the products offered on www.ilcashewficio.com.

Registered office: Via Saporiti 9/3 – 16134 Genoa (GE).

Production facility and collection point: Via Piantelli 12R – 16139 Genoa.

These terms and conditions govern online purchases made by consumers via the Website, in accordance with Legislative Decree 206/2005 (‘Consumer Code’) and Legislative Decree 70/2003 (information society services and electronic commerce).



2) How to complete your order

On the Website, you will find the price, specifications and availability of each product.

To make a purchase, add the item to your basket, fill in the required details, select your payment method and confirm. Submitting your order constitutes a contractual offer.

The contract is deemed to have been concluded when you confirm your order. You will also receive an email confirming your order with a summary (products, prices, delivery charges, addresses). If there are any errors in the summary, please let us know straight away: if the order has not yet been processed, we will be able to correct them.

Note on handcrafted items: the images are for illustrative purposes only; minor variations in shape or colour are normal in handcrafted production. In the event of any discrepancy, the written product description shall prevail.




3) Availability and prices

All prices are in euros and include VAT. Delivery charges are shown at checkout.

Availability is carefully updated but may vary: if an item is unavailable, we will notify you promptly and offer alternatives, partial dispatch or a refund for the missing item.




4) Secure Payments

We accept Visa, Mastercard, Apple Pay and Google Pay via the Website’s payment gateway. Bank transfers and cash on delivery are not currently available.

Payments are processed via secure channels; the Website does not store your full card details.



5) Dispatch, packaging and delivery

We dispatch to Italy via express courier. We use insulated packaging and ice/gel packs to keep the contents fresh during transit.

Estimated delivery times: 24–48–72 working hours depending on the location (islands and remote areas may take longer). You’ll receive a tracking number by email as soon as we hand the parcel over to the courier. In the event of a delay, please don’t worry – as these are plant-based products, they are less sensitive to temperature than products of animal origin. If you have any concerns, please write to us and we’ll be happy to help.

Collections: you can select “Collect from our workshop” in Genoa; we’ll notify you by email when your order is ready (the address and opening hours are provided in the email).

Courier delays: if there are unforeseen circumstances beyond our control, we’ll still do our best to assist you until delivery.




6) Fresh food products and the right of withdrawal

We sell fresh and/or perishable food products. Pursuant to Article 59(d) and (e) of Legislative Decree 21/2014, the right of withdrawal does not apply to goods that are liable to deteriorate or expire rapidly, or to sealed goods that are unsuitable for return for hygiene reasons once opened.

Consequently, the right of withdrawal does not apply to food sold on the Website. Naturally, protection in the event of non-conformity or defects remains unaffected, as set out in point 8.


7) Cancellation or amendment of the order

Cancellation or amendment may be requested within 24 hours of order confirmation and only if order preparation has not yet begun. After this time, the order proceeds to preparation/dispatch and can no longer be amended.




8) Checking the goods, non-conformities and customer support

Upon delivery, please check that the parcel is undamaged. If you notice any visible damage, sign ‘subject to reservation’, specifying the problem to the courier, and take photos of the parcel.

For damaged parcels or non-compliant products, please contact us within 24 hours of arrival at info@ilcashewficio.com, attaching clear photographs of the parcel and its contents. We will prioritise your case and offer you an appropriate solution (replacement, refund or voucher), in accordance with the Consumer Code (Legislative Decree 206/2005).




9) Invoices

We issue invoices upon express request made during the ordering process. Please remember to provide your tax details correctly (company name, address, VAT number/tax code). Requests made after the order has been finalised cannot be guaranteed.



10) Liability and force majeure

We are committed to providing accurate information and a prompt service. We may correct errors or omissions in prices or descriptions even after an order has been placed (whilst notifying you in advance and safeguarding your rights).

We shall not be liable for delays or failures to perform due to force majeure or events attributable to third parties (e.g. the courier), without prejudice to your right to delivery or a refund in accordance with the law. This is without prejudice to cases of wilful misconduct or gross negligence.

12) Applicable law, ODR and jurisdiction

The online sales contract is deemed to have been concluded in Italy and is governed by Italian law (Legislative Decree 206/2005 and Legislative Decree 70/2003).

Online Dispute Resolution (ODR): in accordance with EU Regulation 524/2013, you may use the European ODR platform available on the European Commission’s website.

Competent court: the Court of Genoa shall have exclusive jurisdiction over any dispute, without prejudice to any mandatory provisions for the protection of consumers (where applicable).


13) Specific acceptance (Article 1341 of the Italian Civil Code)

By proceeding with the purchase, you declare that you have read and accepted these terms and conditions and, pursuant to Article 1341 of the Italian Civil Code, expressly approve the clauses concerning: conclusion of the contract (point 2), availability and prices (3), payments (4), dispatch and delivery (5), exclusion of the right of withdrawal for perishable goods (6), order cancellation/amendment (7), inspection of goods and non-conformity (8), limitations of liability/force majeure (10), and jurisdiction (12).
